APPENDIX C: CODE OF CONDUCT

TERMS AND CONDITIONS OF SERVICE

This Code of Conduct ("Code") is an integral component of the Terms and Conditions of Service ("Terms"). Any terms not defined in this Code shall have the meanings ascribed to them in the Terms. By utilizing the Platform, you agree to comply with and be bound by this Code of Conduct. Any violation of this Code is considered a significant breach of the Terms, and depending on the nature of the violation, it may result in immediate account suspension or termination, a permanent ban from the Platform, and potential civil or criminal legal consequences.

User Conduct:

You agree to adhere to the following guidelines:​

  1. Legal Compliance:
    • When using the Platform, you must abide by all applicable laws and refrain from engaging in any unlawful activities. This includes activities that could subject us to criminal or civil liability.
  2. Account Security:
    • You are responsible for safeguarding your username and password, ensuring the security of your login information, and preventing unauthorized access. You must not attempt to use another Community Member's account, nor transfer your Account(s) to others.
  3. Responsible Account Usage:
    • You are solely accountable for all activities carried out through your Account when interacting with others on the Platform. Sharing, discussing, or requesting any content that is infringing, defamatory, obscene, lewd, violent, harassing, discriminatory (racist, sexist, transphobic, ableist, etc.), invasive of privacy rights, unlawful, or otherwise offensive is strictly prohibited.
  4. Confidentiality:
    • You agree to keep all information obtained from or provided through the Platform confidential and refrain from disclosing such information to anyone without the permission of the respective person who shared it.
  5. Content Recording:
    • It is prohibited to record or capture any content shared and/or streamed by other users of the Platform for any reason.
  6. Rights Infringement and Unlawful Material:
    • The Platform must not be used to violate the privacy rights, property rights, or other civil rights of any person. Similarly, it is forbidden to unlawfully obtain, create, or distribute copyrighted material, including posting or requesting materials for which you or the involved party lack legal rights.
  7. Prohibition of Spam and Unsolicited Communications:
    • Utilizing the Platform to publish, forward, or send chain letters, advertisements, spam, or similar commercial messages is strictly prohibited. Unsolicited communications to Community Members are only permitted within the normal chat service.
  8. Identity Concealment:
    • Taking actions to conceal your identity, such as using fake or altered profile information, manipulated headers, or other methods to hide the source of communication, is strictly prohibited.
  9. Uniforms and Attire:
    • Wearing service uniforms, including military uniforms or religious attire, is not allowed while using the Platform.
  10. Unfair Account Enhancement:
    • Employing any automated or semi-automated means to unfairly enhance an account, such as creating a false impression of chatroom traffic or artificially increasing follower counts, is prohibited.
  11. Ban Circumvention:
    • Creating additional accounts with the intention of evading a ban imposed by us or another Community Member is strictly prohibited.
  12. Prohibition of Obscene Materials and Protection of Minors:
    • The Platform must not be used to send or request obscene materials, including child pornography or materials offensive to a person's dignity. It is strictly forbidden to allow individuals below the Age of Majority to appear in any Community Member Content or access/use the Platform.
  13. Personal Data and Usage Information:
    • Obtaining personal data or usage information from the Platform, whether manually or through automated means, regardless of whether the data is aggregated and anonymized or personally identifiable, is prohibited. Using automated tools like robots, crawlers, or other data mining tools to collect data is strictly forbidden.
  14. Security Features and Malicious Code:
    • Any attempt to bypass the site's security features or reverse engineer any code or content is prohibited. Additionally, posting links to third-party sites or introducing malicious code to the Platform in any manner is strictly forbidden.
  15. Personal Use Only:
    • The Platform is intended for personal enjoyment only. 
  16. Privacy Policy:
    • You must not engage in any actions, either individually or collectively, that directly or indirectly violate our Privacy Policy.
  17. Non-Disclosure of Personally Identifiable Information:
    • Revealing personally identifiable information about any Community Member or requesting such information is strictly prohibited.
  18. Prostitution and Commercial Webcam Services:
    • Using the Platform to offer, discuss, or arrange prostitution, escort services, or any form of compensation-based meeting arrangements is prohibited. Independent Broadcasters may exchange information with Community Members, including contact information, but they are not permitted to provide webcam shows or receive payments outside of the Platform. If an Independent Broadcaster sells something to a Community Member (e.g., underwear), the transaction must be completed in exchange for tokens.
  19. Advertisement of Commercial Webcam Sites:
    • Under no circumstances are you allowed to advertise commercial websites offering live webcam streams. However, Community Members may mention their own personal profiles, homepages, and wish lists.
  20. Defamation and Disparagement:
    • Making any statements, written or verbal, or encouraging others to make statements that defame, disparage, or criticize the Platform or the Company is prohibited.

Rules for Community Member Content:

The Platform maintains specific rules governing Community Member Content, which all Community Members must adhere to. The following acts and content are strictly prohibited on the Platform, and no Community Member may post, broadcast, or solicit others to post or broadcast such content.​

  1. Obscenity: Materials or actions that are considered obscene, including actual or simulated depictions of rape, incest, child pornography, bestiality, or any other actions or materials that may be deemed obscene or illegal in your community, are strictly prohibited.
  2. Illegal and Unsafe Actions: Depictions of actual or simulated illegal and unsafe actions, such as violence, weapons, erotic asphyxiation, rape themes, or any actions associated with causing physical or emotional harm, are strictly prohibited. The use of illegal drugs or drugs that may be perceived as illegal in certain locations (such as medicinal marijuana) is also prohibited.

  3. Large or Unusual Sex Toys: Objects may only be used as sex toys if they are normally marketed and sold for that purpose. For the incorporation of mechanical devices, tools, "sex machines," or other unusual equipment into performances, Independent Broadcasters must contact support@pervert.chat for authorization by submitting a detailed proposal. We reserve the right to revoke authorization at any time and for any reason, at our sole discretion.
  4. Child Pornography and Depictions of Minors: Child pornography, as well as depictions of minors (actual or simulated) on the Platform and in any Community Member Content, are strictly prohibited. No actual or simulated minors, children, babies, or unauthorized persons are allowed on camera or in the same room. This prohibition includes offering, role play, and/or discussion of minors. Violations of this rule will result in immediate reporting to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement agencies, at our sole discretion.
  5. Intoxication: Performing while intoxicated, whether from alcohol or drugs (prescription, legal, or illegal), is strictly prohibited.
  6. Offensive and Degrading Conduct: Engaging in offensive and/or degrading conduct, including the use of degrading or verbally abusive dialogue or engaging in offensive role play, such as ethnic or racial role play, is not allowed.
  7. Sleeping on Camera: Sleeping on camera, whether real or acting/pretending, is not permitted.
  8. Live Streaming and Non-Interactive Content: Live streaming or broadcasting recorded content, or any other form of non-interactive content, is not permitted. Recorded videos may only be shared through the bio/profile page. Independent Broadcasters may use cartoons, avatars, and other interactive digitally created images, subject to concept review by our support team, provided they comply with the Code of Conduct and the Terms.

Please note that these lists are not exhaustive, and we reserve the right, at our sole and absolute discretion, to prohibit any activity we deem inappropriate. We may terminate or suspend your access to all or part of the Platform at any time, with or without notice, if you engage in any inappropriate activity.
